Defence of engineering firm

HBA defended an engineering firm in proceedings issued out of the Supreme Court of Victoria. 

The dispute arose from a failed commercial property construction and related development works, with a value in excess of AU$120 million. 

The proceedings engaged 12 separate parties across the full range of disciplines associated with a large building and construction project, including architectural design and planning, building works, structural engineering, geotechnical engineering, hydrological engineering, construction programming and delivery, quantum analysis and remediation. 

Our client was a cross-defendant in the proceedings, having provided structural engineering services in connection with, but not limited to, concrete slab design and construction.

The dispute and proceedings were heavily contested, as evidenced by the number of parties. The inter-action between expert disciplines added a particular and recurring complexity to the proceedings with the associated necessity to manage extensive industry knowledge and details in connection with large commercial construction projects.

We succeeded and the case against our client was dismissed, with costs awarded.
