Numerous issues uncovered when taking over CTP file load
After HBA Legal took over a CTP file load from fellow solicitors in Queensland, we identified a number of actions to decrease our new client’s exposure.
In one matter alone, we identified and took the following action:
- Identified a breach of warranty/policy that ought to have been plead against the insured owner;
- Amendment of a liability response to reduce liability only to those matters covered under the MAIA and claim contributory negligence;
- Notifications to third party of the intention to join them to the proceedings, noting Precourt procedures hold no avenue for those recovery actions;
- Once proceedings were commenced, joining the third parties to the claims, with pursuit of the third parties;
- The joinder of those parties resulted in a reduction of the client’s exposure by at least 50%.
