Law firm serves up negligent advice
Our team acted in a professional indemnity claim against a law firm, on behalf of a company in an under deductible claim.
In this matter, the lawyer, who did not usually act in these types of matters, acted in a settlement of a workers’ compensation claim in which there was a contractual indemnity and breach of contract claim.
The law firm recommend payment by the client directly of more than $200k on the basis that they were uninsured for the claim.
HBA assisted the client to pursue reimbursement of that amount from the law firm on the basis that its advice was negligent and the indemnity was in fact unenforceable. We commenced proceedings and the matter was ultimately settled for the full amount of reimbursement.
