Natasha Burn

Practising exclusively in commercial litigation (with a focus on insurance litigation) since 2009, Natasha primarily represents public and private hospitals, health practitioners, healthcare entities, major corporations, as well as private insurers and state and Commonwealth government agencies.  While she leads HBA’s Medical Malpractice and Health team on the west coast, her clients extend across the country in all Australian jurisdictions.

Natasha has earned an enviable reputation and track record for managing a diverse portfolio of highly sensitive matters, across the insurance law landscape.  She is considered a health law expert, handling all manner of matters, with a focus on complex and catastrophic negligence claims against medical professionals. 

Natasha has been recognised by the highly respected Doyle’s Guide as a leading Medical Negligence & Malpractice lawyer every year since 2020.

She also has vast experience in industrial diseases, life insurance, property damage claims as well as disciplinary, regulatory and coronial investigations. She regularly advises on the interpretation of insurance contracts in professional indemnity and life insurance matters and has appeared as Counsel and instructing solicitor in the Federal Court of Australia on employment practices and human rights law matters.

As an experienced litigator, Natasha regularly appears as Counsel at pre-trial and mediation conferences in the Magistrates, District, and Supreme Courts of Western Australia and in the Federal Court of Australia, and also at informal conferences where she frequently negotiates the resolution of claims on behalf of major insurer, government and corporate clients.

When it comes to litigated claims, Natasha’s track record extends to the defence of thousands of medical negligence and public liability claims including the case of Carter v Railway Motel Pty Ltd [2016] WADC 102, in which Natasha instructed a major insurer in the successful defence of a public liability claim alleging breaches of the WA Occupier’s Liability Act

Natasha is efficient, pragmatic and approachable. She is known for investing time in discussing the concerns and objectives of each client to properly understand their operations and priorities. This enables her to provide strategic advice focused on pragmatic and directed settlement strategies, which are adopted to meet individual client goals but also necessarily underpinned by an accurate assessment of liability and quantum.

Natasha actively supports the professional development health practitioners and other lawyers as an author for various LexisNexis publications, including the Australian Health Law Bulletin, and via her role as a regular and popular presenter of informative legal education seminars.

She graduated from the University of Western Australia with a Bachelor of Laws and Bachelor of Arts (Political Science) in 2008.

  • Acting on instructions from large private hospitals in respect to medical negligence/malpractice claims against hospital employed nurses, technicians, doctors, and surgeons.
  • Acting on instructions from a national healthcare entity in respect to a wrongful birth claim against a radiology clinic, arising out of an alleged negligently performed antenatal scan.
  • Acting on instructions from underwriters, including claims by a body corporate, under its D&O policy, in relation to a defamation civil suit against one of its body corporate directors.
