Bree Rosagro
A seasoned defendant-based litigator, Bree has dedicated her entire career to insurance law. Bree acts for government agencies, private insurers and major national companies. Thanks to her government work, Bree has a sound appreciation of model litigant principles and is committed to approaching every matter with integrity, fairness and transparency.
Bree’s litigation experience covers motor vehicle personal injury claims (including Fatal Accidents Act claims and catastrophic claims), medical negligence, public liability, workers’ compensation (predominately common law claims), industrial diseases claims, professional indemnity, Total and Permanent Disability (TPD) claims and third-party claims on behalf of insurers. Bree has significant experience with motor vehicle property damage claims, property damage claims, credit hire claims and general insurance matters (including fraudulent claims on business insurance).
Bree is highly regarded for her knowledge and experience with respect to the issue of legal costs and is an asset to our team when dealing with the final issue of often long standing and complex matters. Bree can quickly get across the nuances of a matter to provide advice to the client on an appropriate counteroffer with respect to the Plaintiff’s Bill of Costs, in an attempt to avoid the additional costs and delays associated with attending a taxation hearing.
Conversely, Bree has also prepared Bills of Costs and attended taxations of those bills when clients have been successful in obtaining costs orders against the Plaintiff (following judgment in our client’s favour at trial).
She regularly represents her clients at informal settlement conferences, Pre-trial Conferences and Mediation Conferences. Her preparedness and accurate quantum assessments of claims, combined with her negotiation skills means that over 95% of Bree’s matters resolve at the first conference.
Bree prides herself on providing pragmatic advice in a timely and cost-effective manner; she works hard to achieve resolution of claims on the best possible terms. One thing clients particularly appreciate about Bree is her willingness to assist them with ad-hoc advice and guidance on non-matter related issues. She is always available to assist at short notice and in the absence of being formally instructed on a matter.
Her career has also included several years working as the Legal Director of a self-insured credit hire car company. In this role, Bree managed claims across most Australian jurisdictions using Proclaim, an online claims management system. Bree oversaw the litigation of over 1,500 property damage claims, credit hire claims and motor vehicle property damage claims at any one time.
Bree holds a Bachelor of Arts (majoring in Japanese) and a Bachelor of Commerce (majoring in International Business) from Curtin University. She achieved her post-graduate Bachelor of Laws from Notre Dame University in 2005.
Examples of Bree’s recent experience
- Acting for a third party (employer) in a mesothelioma case that resolved on the first day of a 10-day jury trial (Supreme Court of Queensland). The matter involved three Defendants (all manufacturers of the brake products that contained asbestos), four third parties (all past employers of the Plaintiff) and six fourth parties. Bree’s client had the largest liability for the claim, and she was able to successfully negotiate settlement on terms very favourable to her client.
- Defending defamation proceedings in the Supreme Court of Western Australia on behalf of a professional peak body. The Plaintiff had been an antagonist of the peak body over many years, but had a continuing professional relationship with them. Bree was able to successfully resolve the matter at a Mediation Conference on terms favourable to her client and their members.
- Successfully negotiating settlement of a personal injury claim against a major supermarket on the basis that they made no contribution to the Plaintiff’s damages (which were paid by the other two Defendants), an outcome that was very favourable to her client given the real risk that a finding of liability would have been made against her client had the matter proceeded to trial.
- Resolving the apportionment of a motor vehicle personal injury claim on the basis of 50/50 liability between the Plaintiff and the Defendant, when the most analogous case from the New South Wales Court of Appeal supported apportioning liability 80/20 in favour of the Plaintiff, resulting in a significant cost saving to her client.
- Drafting the Bill of Costs on a matter where HBA Legal was successful at trial as the amount of damages awarded to a Plaintiff was less than what we had previously offered, which meant that our client was awarded their costs from the date of the offer. Bree prepared the Bill of Costs and attended the taxation hearing where less than 5% of the bill was taxed off, meaning that the Plaintiff ended up owing our client money over and above the amount awarded to him at trial (which HBA had previously argued should be stayed).
